Speeding violation
02. Areas of law
Did you drive too fast and get caught? We defend you.
In fact, speeding is the main reason for administrative offenses in Germany. Every year, around three million people fall into the trap of speed cameras while traveling at excessive speeds. Along with traffic density, speed is a fundamental factor in road traffic. The traffic flow, travel time, risk of accidents, accident severity, environmental impact (noise, exhaust gases and road pollution), fuel consumption and driver stress depend on this.
While there are regulations regarding maximum speed almost everywhere, minimum speeds or recommended speeds only exist in certain countries. A particular danger arises from excessive speed (speeding), which is the cause of the vast majority of traffic fatalities, usually in connection with insufficient safety distance. Road users who intentionally drive at significantly excessive speeds are colloquially referred to as speeders.
It is not uncommon for speeding to cost dearly. In addition to fines, speeders face points in the Flensburg central register and a driving ban that may last for months. You can find out in our office when fines have to be paid, in which cases your driving license is lost and what else you need to know about the most popular administrative offense in Germany. If you drove too fast, were caught speeding, and perhaps all of that wrongly, then you need a competent law firm that has excellent knowledge of traffic and often criminal law. We combine both areas of law because there is a lot of overlap, which often also constitutes a crime for traffic offenders. Make an appointment at our office in Berlin today.
Speed controlexceeding tolerance
The tolerance deduction outside built-up areas or the tolerance deduction in road traffic is 3 km/h at speeds below 100 km/h. If the speed was more than 100 km/h, the tolerance value is higher. So about 3% of the total speed is deducted.
The value that is deducted is never a uniform value. It always depends on the respective measuring method used as a traffic monitoring device. In the event of a dispute in court, the judge determines the tolerance value. The value for the tolerance deduction itself is initially set by the Physical-Technical Federal Institute.
Factors influencing tolerance?
-
Which measurement methods were used?
-
Driving at night or poor visibility
-
The measured value was created by a follow-up trip by the police (then higher error tolerances are applied)
-
Another detail when calculating the tolerance value is non-calibrated devices. In this case, higher tolerance values are determined. In addition, the following applies: A measurement is only valid if all deadlines for calibration of the devices have been met.
-
Path tolerance must always be taken into account. This means that speed measurements may only be carried out at a distance of 150 to 200 meters from a speed limit (e.g. traffic signs).
-
There are always different tolerance values for urban areas, out-of-town areas and on motorways
-
The tolerance value is not deducted from the tachometer value, but from the measured value.
